A district court has to take a better look at whether a lawyer, who was denied permission to withdraw as appointed counsel in a criminal case and then became of-counsel at a firm that created a conflict of interest with his client, manufactured the conflict or is entitled to withdraw, the Third Circuit said Tuesday.
After Alexander Golubitsky was denied permission to withdraw from Wayne Bellille’s Racketeer Influenced and Corrupt Organization Act case, he became of-counsel at DiRuzzo & Company. He said the move was made so he could better represent Bellille.
